- We never prohibit our Sellers from contacting or communicating with their lender or servicer. The Hightower Team encourages open communication between all parties.
- The Colorado foreclosure process is a complex set of rules and regulation. We will not misrepresent the likelihood of success for the foreclosure consulting that we provide.
- The Hightower Team does not misrepresent the amount of time it will take to complete a short sale, or any of our services.
- We are not affiliated, endorsed or approved by any lender, servicer, government, nonprofit organization, or any other entity or person other than The Hightower Team and it’s employees.
- All Homeowners must understand their obligation(s) under their home loan(s). The Hightower Team will not misrepresent the terms and conditions of a Seller’s relief offered by their lender.
- The Hightower Team will never discuss terms and conditions of a refund, cancellation or repurchase policy under the services provided to our clients.
- We earn a success fee upon the completion of a successful closing. The Hightower Team will not misrepresent our services to earn a fee.
- A Seller will not receive legal representation from The Hightower Team. We will not represent any alternatives to the services we provide, or a cost for those services.
- The Hightower Team will not misrepresent the amount of money or the percentage of debt the seller may save by using our service, or the benefits of using The Hightower Team.
- The Hightower Team will pass along all notices received from the Seller’s lender to our clients. Withholding this information is illegal and is not in the best interest of anyone.
No Upfront Fees
Mortgage Assistance Relief Services Rule 16 CFR 322 makes it illegal for real estate brokers to charge upfront fees to Sellers selling via short sale. These fees cannot be charged prior to a short sale acceptance signed by the Seller. This includes short sale coordinator’s fee, or any other upfront cost. If a real estate broker is asking for upfront fees, contact their broker and have them review MARS regulation.
Upon Short Sale Acceptance
Prior to our Seller’s short sale acceptance, The Hightower Team discloses the following, in writing:
This is an offer of Short Sale Terms (mortgage assistance) we obtained from your lender or the servicer of your loan. You may accept or reject the offer. If you reject the offer, you do not have to pay us. If you accept the offer, The Hightower Team will earn a real estate commission. Your lender has agreed to include our commission as part of the Short Sale Approval. This will result in a reduced net to your lender but will prevent you from needing to bring these funds to the closing.
IMPORTANT NOTICE
The Federal Trade Commission issued the Mortgage Assistance Relief Services Rule 16 CFR 322 (MARS). MARS defines “mortgage assistance relief service” to include: “negotiating, obtaining or arranging a short sale of a dwelling.”
You may stop doing business with us at any time. You may accept or reject the offer of mortgage assistance we obtain from your lender (or servicer). If you reject the offer, you do not have to pay us. If you accept the offer, you will have to pay us the amount agreed in our listing agreement for our services. Keller Williams and The Hightower Team are not associated with the government and our service is not approved by the government or your mortgage lender. Even if you accept this offer and use our service, your lender may not agree to change your loan. Please be aware that if you stop paying your mortgage, you could lose your home and damage your credit rating.
